NATIONAL SECOND CHANCE NETWORK (NSCN) FindSecondChance.com TERMS OF SERVICE

SECTION 1 — ACCEPTANCE OF TERMS

By accessing, browsing, or using FindSecondChance.com or any service, tool, resource, or feature operated by the National Second Chance Network ("NSCN"), you agree to be bound by these Terms of Service. If you do not agree to these Terms of Service, you must discontinue use of the platform immediately. These Terms of Service apply to all visitors, users, community members, network professionals, and any other individual or entity that accesses or interacts with FindSecondChance.com in any capacity. NSCN reserves the right to update, revise, or modify these Terms of Service at any time and for any reason at its sole discretion. When changes are made, the revised Terms of Service will be posted on FindSecondChance.com with an updated "Last Updated" date. Your continued use of FindSecondChance.com after any changes are posted constitutes your acceptance of the updated Terms of Service. If you do not agree to any revised terms, your sole remedy is to discontinue use of the platform.

SECTION 2 — DESCRIPTION OF SERVICES

NSCN operates a housing intelligence and network platform through FindSecondChance.com. The platform provides educational resources, housing search tools, proprietary data intelligence tools, verified articles, and network connections for individuals navigating barriers in housing, including but not limited to eviction history, criminal background, low credit, broken leases, and voucher-based rental assistance. NSCN also operates a professional network that connects users with independent professionals and organizations across housing, legal, financial, career, and homeownership service categories. NSCN does not guarantee apartment approval, lease signing, housing placement, legal outcomes, credit improvement, employment placement, or any other specific result. All services are provided on an "as is" and "as available" basis.

SECTION 3 — ELIGIBILITY

FindSecondChance.com is intended for use by individuals who are eighteen (18) years of age or older. By using the platform, you represent and warrant that you are at least eighteen years of age and that you have the legal capacity to enter into these Terms of Service. If you are under eighteen years of age, you must discontinue use of the platform immediately.

SECTION 4 — USER CONDUCT

By using FindSecondChance.com, you agree that you will not submit false, misleading, or fraudulent information through any form, intake pathway, or communication channel on the platform. You will not use the platform for any purpose that is unlawful, abusive, harassing, threatening, defamatory, or otherwise objectionable. You will not attempt to gain unauthorized access to any portion of the platform, any systems or networks connected to the platform, or any NSCN server. You will not use any automated system, software, bot, scraper, or similar technology to access, collect, or extract data from FindSecondChance.com without the express written permission of NSCN. You will not use the platform to distribute spam, unsolicited advertisements, or commercial solicitations. You will not impersonate any person or entity or misrepresent your affiliation with any person or entity. You will not interfere with or disrupt the operation of the platform or the servers and networks used to make the platform available. Violation of any of these terms may result in the immediate suspension or permanent termination of your access to all NSCN services without prior notice and without liability.

SECTION 5 — INTELLECTUAL PROPERTY

All content, materials, tools, data, designs, graphics, text, articles, templates, worksheets, checklists, research products, intelligence products, datasets, indexes, registries, and any other materials available on or through FindSecondChance.com are the exclusive intellectual property of the operating entity unless otherwise noted. This includes but is not limited to the PHA Policy Monitor, SOI Law Tracker, Eviction Filing Index, Voucher Funding Tracker, Voucher Success Rate Monitor, Manual Review Accelerator, Residency Profile Architect, Income Authority Engine, NSCN Quarterly Report, and all content published under the NSCN brand. You may access and use NSCN content for personal, non-commercial, educational purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any NSCN content for commercial purposes without the express written permission of NSCN. If you share or reference NSCN content, you must provide clear attribution in the following format: "Source: National Second Chance Network, FindSecondChance.com" with a direct link to the original content.

SECTION 6 — DISCLAIMER OF WARRANTIES

FindSecondChance.com and all services, tools, resources, content, and features provided through the platform are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. NSCN disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. NSCN does not warrant that the platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. NSCN does not warrant the accuracy, completeness, reliability, or timeliness of any information, content, data, or materials provided through the platform. Your use of FindSecondChance.com is at your sole risk.

SECTION 7 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, NSCN, its officers, directors, employees, agents, affiliates, partners, and contractors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of or inability to use FindSecondChance.com, any services provided through the platform, any content or materials obtained from the platform, any conduct of any third party on the platform, or any unauthorized access to or alteration of your information. This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise, and regardless of whether NSCN has been advised of the possibility of such damages. In no event shall NSCN's total liability to you for all claims arising out of or in connection with your use of FindSecondChance.com exceed the amount you have paid to NSCN in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty dollars ($50.00), whichever is greater.

SECTION 8 — PROPRIETARY TOOLS & EDUCATIONAL CONTENT

The National Second Chance Network provides a suite of proprietary tools and educational resources through FindSecondChance.com, including but not limited to the PHA Policy Monitor, SOI Law Tracker, Eviction Filing Index, Voucher Funding Tracker, Voucher Success Rate Monitor, Manual Review Accelerator, Residency Profile Architect, Income Authority Engine, and the NSCN Quarterly Report. These tools are provided for educational and informational purposes only. Use of any NSCN proprietary tool does not create a professional-client relationship of any kind, including but not limited to an attorney-client relationship, a financial advisory relationship, a tax advisory relationship, or a counseling relationship. No information provided through any NSCN tool constitutes legal advice, financial advice, tax advice, or housing counseling. Users are responsible for independently verifying all information obtained through NSCN tools before making decisions based on that information. Use of NSCN proprietary tools is governed by the NSCN Tools Disclaimer & Data Policy, available at FindSecondChance.com/tools-disclaimer, which is incorporated into these Terms of Service by reference.

SECTION 9 — PARTNERSHIP NETWORK & REFERRAL SERVICES

NSCN facilitates connections between users and independent organizations, including but not limited to Public Housing Authorities, legal aid organizations, housing counseling agencies, reentry service providers, workforce development programs, community development financial institutions, landlord associations, and domestic violence service providers. NSCN does not control, manage, oversee, employ, or direct any partner organization or independent professional connected through the platform. Inclusion in the NSCN network or on any NSCN partnership list does not constitute an endorsement, guarantee, or certification of any organization's services, competence, or outcomes unless the organization has been formally designated as an NSCN Verified Partner through a written agreement with NSCN. NSCN does not guarantee that any partner organization will accept your case, provide services, or produce any specific outcome. Decisions regarding eligibility, service provision, housing placement, legal representation, and all other matters are made solely by the partner organization in accordance with their own policies and applicable law. Any dispute between you and a partner organization connected through the NSCN network is between you and that organization. NSCN is not a party to any agreement, engagement, or transaction between you and any partner organization.

SECTION 10 — REFUND & FEE POLICY

A. Free Services. Many services and resources provided through FindSecondChance.com, including community membership, educational articles, proprietary tool access, and certain platform features, are offered at no cost. Because no payment is involved, no refund situation arises for free services. Availability of free services is subject to change at the sole discretion of NSCN.

B. Fee-Based Services. If NSCN introduces or currently offers fee-based services, products, or subscriptions, all fees will be disclosed to the user in writing before any payment is processed. All paid transactions on FindSecondChance.com are governed by the NSCN No Refund and Digital Access Policy, available at FindSecondChance.com/no-refund-policy, which is incorporated into these Terms of Service by reference. By completing any paid transaction on FindSecondChance.com, you acknowledge that you have read and agreed to the No Refund and Digital Access Policy prior to submitting payment.

C. No Implied Obligation. Access to free services, tools, or resources does not create any entitlement, expectation, or implied obligation that NSCN will continue to provide those services at no cost indefinitely. NSCN reserves the right to modify, limit, suspend, or discontinue any free service or resource at any time without prior notice and without liability.

D. Dispute Resolution. If you have a concern regarding any NSCN service, transaction, or platform experience, contact NSCN directly at nscn@findsecondchance.com or (415) 847-2818 before initiating any external dispute, chargeback, or legal proceeding. NSCN will make a good-faith effort to resolve your concern within thirty (30) days of receiving your written communication. This provision does not limit any rights you may have under applicable law.

SECTION 11 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless NSCN, its officers, directors, employees, agents, affiliates, partners, and contractors from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of FindSecondChance.com, your violation of these Terms of Service, your violation of any applicable law or regulation, your violation of any rights of a third party, or any content or information you submit, post, or transmit through the platform.

SECTION 12 — GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms of Service or your use of FindSecondChance.com shall be brought exclusively in the federal or state courts located in the State of California, and you consent to the personal jurisdiction of such courts.

SECTION 13 — SEVERABILITY

If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the provision.

SECTION 14 — ENTIRE AGREEMENT

These Terms of Service, together with the Privacy Policy, the No Refund and Digital Access Policy, and the Tools Disclaimer & Data Policy, constitute the entire agreement between you and NSCN with respect to your use of FindSecondChance.com and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, with respect to the subject matter hereof.
